I have more video than this, but this was all that was pertinent to this post. I wish I had said on camera before we got there that I expect them to be videtaping the meeting… and the video would be on us.

Because they TOTALLY DID!!!

I called it! Too funny.

We didn’t have to stay long. It didn’t take long to determine this was another unlawful vote. They refused to answer whether the ‘fee’ was a special assessment or a tax. They kept saying it was a Special Maintenance Fee.

But here’s the thing. The law is pretty clear, despite so many people being confused by it, like half of Custer County and the Custer County Auditors Office.

Levy Taxes… and special assessments.

Nothing about Special Maintenance Fees. Nope. Not one word.

So, if a special maitenance fee is not a special assessment, which I have reason to believe it is not, see https://saddlebackroaddistrict.com/a-refresher-on-special-assessments/ where the Department of Revenue is treating it as a different thing than a Special Assessment, then ya’ll can’t use it.

If it IS a special assessment, then ya’ll need to follow the rest of the steps to impose a special assessment. Which… of course… ya’ll didn’t.

Oh, I almost forgot… actually I did forget, and am just now adding this. Remember the last post with the email thread where I asked to see the resolution being voted on? And they said they didn’t have one?
