Talking to a Lawyer

Now, hear me out. I do think we simple people should have the right to represent ourselves. And legally we do. I also firmly believe that the justice system needs an overhaul and that currently lawyers and perhaps judges are acting as gatekeepers to justice.

Over this period of time, coming up on a year, I have spoken to a few attorneys. One of them gave me a great deal of his time, as we had a mutual friend. He said that he thought our case would be dismissed on jurisdictional grounds. I was certain this case could be heard in the small claims court. We were both right. šŸ™‚

See how I see victory when it was mostly a stalemate?

Anyway, I recently got back in touch with him and he is busy till the end of the month, but that’s fine. I also have a message out to another attorney, a friend of a friend, and await their response.

I know we are 100% right on the law, but as I’ve said, the procedures are kicking my ass.

I had learned from an attorney in Michigan that lawyers are offering consulting/coaching services and I asked her if she would consult with us. She suggested finding somebody local, already in the state. I sent out several messages and didn’t get any bites, til now.

I currently have a Petition for a Writ of Mandamus filed, and I may not get they going in the time allotted. So, may need to refile it after I get some guidance.

I cannot legally ā€˜guide you’ but I do think I can legally just tell you what we did. I know the feeling of being right but not being heard. I also think this system will take some time to evolve to include the pro se. That evolution should include education and resources for regular people to take advantage of the system and seek justice.

It may also include encouraging good people who happen to be lawyers, to help the little guy, no matter which side (offense or defense) they are on. The number of times I was referred to ā€œAccess to Justiceā€ and wasted time filling out paperwork when they had no lawyers available, I can’t count.

Suffice it to say, it was numerous. šŸ™‚

Can you imagine how strong this country could be if basic civic and ā€˜rights’ were taught in school?

Do you remember that wonderful ā€œI’m just a bill, just an average bill…?ā€

We should be teaching the US Constitution and Bill of Rights in grade school. The Bob Hummels, Crystal Farrokhis, Dale Ruzickas and Matthew Christensens of the world, who seem to know absolutely nothing about the US Constitution or our rights, or that there are laws to protect the little people, might have benefited greatly.

However, only if they were open to it, and since I’ve provided numerous opportunities over the last year, to learn about any of the many laws that they have violated, and they have simply doubled down and flat out lied concerning them, I’m not sure that these people could have been redeemed even if caught at an early age.

However, others may be.

Imagine a country where the people know they hold the power, and the government answers to them, as it was designed. Imagine representatives who honestly wish to represent the people and not simply rule and be admired.

Imagine a justice system eased by the burden of the clutter of excessive cases concerning the people and the government violating their rights, that would never get to court because the people would speak up for themselves much sooner and the government would have more people involved that would rein in the others and help to oversee them.

This is not going to happen overnight. It will take some time to recover from the decades of our slowly eroding rights and the growth of the government. And therefore government overreach, fraud, abuse and non compliance.

I know that this issue is not just our little road district or even our county. Everybody in the country is likely dealing with something, but they may not even realize it yet.

All this to say that in the interim, we have to utilize whatever tools we can. I’m hoping this lawyer is one.

That doesn’t sound right, but you get my point.

I’m hopeful that this lawyer will help with the circuit court filing for the special assessment, as we know that is a slam dunk. I anticipate he will likely be too busy to get more involved with the other legal actions we have been preparing, so I’m hopeful that the other attorney can help with one or two of those.

Then I’m hopeful that I can move forward with the others on my own. As I said, I’m solid on the law, just not the procedure. Once we have been through this a couple times, it should be easier.

I’ve shared some videos where lawyers are fighting for their clients. They are standing on the law. They are tenacious. They appear to be good people. They are fighting the good fight.

We (all of us) may need to partner with them from time to time.
