Meeting 3
These are the meeting minutes from the 3rd meeting, one month later. I will say again, that while they are still not following all the laws, or even most of them… they did have much better communication skills than the present Board.
Let’s get started.

Still have a single landowner, the Barkers, controlling the Board, and they are still not legal voters. Amundsen, too.
The petition/resolution for annexation which was signed at the January meeting did not have proper legal addresses and signatures. An updated petition was circulated prior to the meeting and remaining signatures will be collected this week. (Petition 1A map & Resolution 2016-5)
The resolution mentioned it did not have legal addresses and signatures. As I do not have any evidence of the petition/resolution for the change of the fee from $200-$400, and all the other petitions were the same till now, I am assuming the ‘tax’ petition, if there was one, was likely incorrect.
Here we have notice that those properties still are not in the district. However those property owners are still controlling the board and the decisions and the district.

Here we have the first, and so far ONLY time that I’ve seen the fee referred to as an assessment. They didn’t call it a “Special Assessment,” … but still. Now this is a letter that we did not get. It was sent to people who didn’t live in the district.
There was still no resolution of necessity. Or any of the other steps required to impose a special assessment. But I didn’t even know it was a special assessment. As far as I know, nobody else did either. It was never referred to as that. And again, none of the steps necessary were followed, so I know we just assumed it was a levy.
Things to note here (in the letter)- ‘This will help all and improve comfort as well as property values.’ Road districts cannot be used for improvements or increasing property values. Well, not lawfully, but clearly that’s what this one was activated for.
“Please help us improve your property values and help your neighbors if you are able.”
Again, a completely unlawful use of a road district.
