$2,500 for Lawyers, or Two Simple Answers?

The financial update presented at the May 26, 2026 Special Meeting contained a noteworthy budget change.

The Board increased the Admin/Legal budget category from $1,500 to $2,500 for:

“anticipated legal consultations with GPNA Law Firm, Rapid City.”

At the same meeting, the Trustees stated that they had discussed two public information requests before deciding to engage GPNA.

Those requests concerned:

1. The source of a claim that the Road District lacks authority to conduct fundraising activities.
2. How the District went from 34 landowners to 33 landowners.

Neither question appears especially complicated.

One seeks the source of information relied upon by the Board.

The other seeks an explanation of a change in the number of landowners reported by the District.

Yet the Board has now budgeted up to $2,500 for legal consultations relating to these matters.

This raises an obvious question:

Why?

If records exist, produce them.

If records do not exist, say so.

If the requested material is not a public record, the Board may simply state that position.

South Dakota already provides a mechanism for resolving public records disputes through the Office of Hearing Examiners.

The process exists specifically to determine whether records must be produced.

The public therefore has a right to wonder why straightforward questions appear to require outside legal counsel at taxpayer expense.

Perhaps there is a compelling explanation.

If so, the easiest path forward is transparency.

What exactly is the legal issue?

What advice is being sought?

And why do two basic records requests require a lawyer when a simple answer might have sufficed?
