I think I already said that we have reason to believe that the judge saw the writing on the wall for us and dismissed the case knowing that we were about to lose… but not because of actual law. By dismissing it, it gives us a chance to refile it.
We had subpoenaed Dana from the auditors office, and intended to simply ask him if the Saddleback Road District was imposing a levy or a special assessment, since it has to be one or the other (or both).
It wasn’t until we received their last motion where they FIRST mentioned the phrase “Special Maintenance Fee” that we realized their plan.
Obfuscation.
Had they honestly believed they were doing everything correctly, they would have mentioned this in the FIRST Answer. In the Motion to dismiss. If it were correct and legal, why not get this over with? Why drag it out?
AH! And there it is. Because it is not legal or correct.
And we then realized that they would easily win by simply asking Dana about special assessments and special maintenance fees, which are NOT the same thing, and Dana would nod and say, yup… ‘same thing.’
This is why I would not refer to him or anybody in that office as an expert. We would have walked right into that. We have asked some state offices about this question and we are right. They are not the same thing. And a road district does not have the right to impose a ‘special maintenance fee.’ That is clear right in the statutes.
When we get answers in writing, we can pursue the next lawsuit. I would not be subpoenaing anybody from the auditors office, as I’m certain that they will be in denial for a long time. They still think that road district meetings do not have to be open to the public. While they say straight faced, “we are not lawyers, and cannot give you legal advice,” they then tell the road district they can do this or that, and invariably it is not correct.
And the rest of us are told to hire an attorney to fight for our rights and to hold these crooks accountable for stealing our money, benefiting themselves personally (unlawfully), and destroying our perfect little road for absolutely no reason, all under the color of ‘office.’ They pat themselves on the back and hold each other up as ‘public servants’ and ‘volunteers’… and ‘we are so noble’, when they are robbing us blind.
In this video you will see allegations of corruption, a crooked judicial system, crooked prosecutors/lawyers, gaslighting, spinning etc etc. Golly, who does that sound like?
By the way, we are looking for a lawyer. We have heard from a couple lawyers who are not local, but who are friends of friends, that nobody is gonna take this on. While we are 100% right on the law, there is no real win here. And it’s the procedure that is holding us up. I have case law, I have opinions and decisions, and we know we are right.
We don’t even need a lawyer to represent us, just help me with the procedure.
There are many lawsuits here, and most are against the board members as individuals, as not one of them is acting lawfully in a position of trustee. So, every single action they have taken and continue to take, is on them personally. And in circuit court, we are not limited to ‘actual damages’, we can sue for more.
Whether these people stay as ‘figureheads’ or not, will not affect their previous actions.
Again, we are waiting for a written response that clarifies this. Nothing this road district has done since 2016 has been lawful. And obviously the state’s attorney really does not want anything to do with this, she has already made a statement, that I recorded while standing at her window, that we are correct.
Great. Doesn’t mean she will move on it.
If we want justice and to hold these people accountable to the extent we can, which is personally and not in their capacity as board members, we could really use a lawyer to guide us with procedure. I’ll do the filing and standing up in court, and we have a pretty good idea what bullshit motion we will have to respond to (the mall claims court was a good dress rehearsal).
If a lawyer DID want to represent us, there is a lot of money sitting there and you are welcome to it. This was never about the money for us. This was about right and wrong. And still is.
And the annual meeting is coming up. You can bet they will break more laws, as they refuse to believe there ARE laws. That’s more money for you.
If you are a newly minted lawyer and think this is small potatoes, keep in mind that the Fani Willis debacle in Georgia started with a simple public records request. We are being denied public records here, by a board that is not lawfully in possession of their positions. Every single action they’ve taken can be pursued on a personal level. They have far more money than the district does. Let me know. I’ll be happy to sit down and show you all our records and documents.
This is a Pandora’s box. You could really get your feet wet in many levels of law and government. The road district is just the lowest hanging fruit.
