Membership (on the Board) has its privileges.
You may recall that the day after the road was ripped up, I called the sheriff’s department to report it. Again, yes, we figured that they would assume this was a civil matter, even though we didn’t. But we still needed to have a report.
The deputy came out, took pics, talked to me and made a call to the treasurer, Crystal Farrokhi, who we wanted on record. The Deputy asked us to each email him our statement, which we did, and then a couple weeks later, when I was in the courthouse anyway filing a complaint for the OMC, I asked for the file.
I’m including her statement.

Oh, so much to unpack here. First, we still find it humorous that no matter the topic or circumstances, they will mention the previous president. The one before Joel. Every single time. The deputy asked her for information relating to THIS event… the tearing up of the road, and her first sentence brings up this guy.
“With the removal of Joel (mind you, done 100% rightfully and legally per our bylaws)” The whole bylaw question is still sketch. I’ll let a judge make a decision on that, but the bylaws are secondary to the state law. There is a process for vacating a seat. And the treasurer and the secretary are not part of it. So, it was not legal. Not even close.
Then she says the road needs very little work- ‘1) it is a very short, flat section of road that requires very minimal work.”
A couple things here. Of course it requires little work, we have been keeping up on it for years, by ourselves. They know nothing about roads and they take their cue from the contractor. What could possibly go wrong? So, no the road didn’t need any work. She is completely right.
So, why then did you have it torn up?
And the best part of her statement was the second part of that sentence, ‘2) Both Dachia herself and Joel have been in the position of president on the board, so if anything needed to be done, it should/could have been addressed when they were in office!’
Oh… is that how it’s done? You become a trustee and then you have a say in where the money is spent? Good to know. Because this is not something that would have occurred to either Joel or myself.
(ETA-Updating that it doesn’t matter what the bylaws say, as ousting an elected officer is not lawful… period. You’ll see why as you read further and get caught up. I link to the law.)
